AZ: State’s high court may consider ‘adult’ stores’ hours
The Arizona Republic reports on the recent ruling in State v. Stummer:
The state’s high court is likely going to have to wade into the debate after a recent ruling by one division of the Arizona Court of Appeals upholding a state law requiring “sexually oriented businesses” to close each night at 1 a.m. That law permits them to reopen at 8 a.m. Monday through Saturday, but not until noon on Sunday. But a different division of the appellate court, looking at the same law, reached the opposite decision five years ago. “I think the (state) Supreme Court will have to take it,” said Peter Gentala, counsel for the Center for Arizona Policy . . .
