I lived in Pa for over 25 years and moved back to New Jersey. My mother lived with a man for 25 years and they lived in her house (her and my late father's name was on the deed). She thought her only asset was safe because of "no common law marriage" in New Jersey. Well, a bunch of Supreme Court Justices changed that. A rich man's mistress sued his wife and children for palimony after he died. The court ruled in her favor. Because of this when my mother wanted to sell her house, her boyfried became physically abusive and refused to leave. She died and when I tried to remove him (I offered him assistance until he got a senior citizen apartment) the police in Passaic, NJ told me I needed a court order. When I went to a lawyer and filed a motion to eject him, I and my sister were sued. I was the executor of her estate and I walked into a trap. Furthermore, I was paying the property tax ($7,000), the lawyer and paid for her funeral. A judge in Paterson refused to sell the property while the litigation was proceeding. AND there was a medicaid lien on the property. Her boyfriend had rights given to him by the Supreme Court of New Jersey. I finally settled with the boyfriend because I ran out of money to fight the case. He had a "contingency fee" lawyer AND LEGAL AID helping him for free. When you pass a defense of marriage act, please make sure you protect children and spouses from palimony suits. Thank you.
