DOJ seeks to hold Mississippi pro-lifer in contempt of court

The Clarion Ledger reports:

Longtime anti-abortion protester Roy McMillan admitted in court Friday that he had twice broken a federal agreement to stay 25 feet from Mississippi’s only abortion clinic . . .

The Department of Justice is asking the court to:

  • Change the clinic buffer zone from 25 feet to 50 feet.
  • Give compensatory damage of $5,000 to Booker for each of the four threats McMillan allegedly made against him.
  • Issue an order that any future violation of the decree’s buffer zone will bring a $1,000 fine.
  • Issue an order stating any future violation of the consent decree’s prohibition on threats will bring a $5,000 fine.”We think the court gave us a fair hearing and we’ll find out next week (whether McMillan can be held in contempt),” said Michael Marks, McMillan’s attorney.

    Wingate fined McMillan $1,000 in 1999 for threatening workers at the now-defunct New Woman’s Medical Clinic.

    The consent decree, which McMillan signed, stems from a 1995 suit filed by the Justice Department accusing McMillan of violating the federal Freedom of Access to Clinic Entrances Act.
