NM: Photographers Denied the Freedom To Choose What They Photograph



On the Volokh Conspiracy, Eugene Volokh comments on this case being handled by the Alliance Defense Fund. He begins:

Elaine Huguenin co-owns Elane Photography with her husband. The bulk of Elane’s work is done by Elaine, though she subcontracts some of the work some of the time. Elane refused to photograph Vanessa Willock’s same-sex commitment ceremonies, and just today the New Mexico Human Rights Commission held that this violated state antidiscrimination law. Elane has been ordered to pay over $6600 in attorney’s fees and costs.

    When did the minority of America start running the country? When did all American Christians loose the right to say no and everyone of American freedoms? If you get told no, so what go find someone else

    Why would ANYONE want a photographer who doesn’t believe in homosexuality to take pictures of a commitment ceremony?

    ANSWER: to stir up trouble, obviously.

    I’d take the photos. Not my fault I had too much coffee and was a bit shakey.
