Supreme factual blunder in child rape death penalty case?



Jonathan Adler has this post reporting that Justice Kennedy incorrectly stated that there is no federal penalty for child rape under federal law. Since the Supreme Court seems to base much of its jurisprudence on current trends, he queries whether a Petition for Reconsideration might be warranted?
