. . . While laws allowing nationwide domestic partnerships are unlikely, American Civil Liberties Union lawyer Matt Coles said changes could be made to the national Defense of Marriage Act so that same-sex couples would get federal benefits and recognition in states that do allow marriage.
And he said a federal law to stop employment discrimination on the basis of sexual orientation could pass.
More broadly, gay activists will focus on the argument that gays deserve civil rights protection as minorities. Some voters uncomfortable with homosexuality are nevertheless open to the idea that gays deserve legal protections — and that such change is coming.
“Anyone who thinks this is over is kidding themselves,” Coles said. “If I was the other side, I’d be distressed.” . . .
