ADF urges Senate Judiciary Committee to reject Administration’s DOJ nomineeshttp://www.alliancedefensefund.org/news/story.aspx?cid=4829 ALLIANCE DEFENSE FUND NEWS RELEASE ADF attorneys: President’s four most recent Dept. of Justice nominees will undermine constitutional law in our courts WASHINGTON — The Alliance Defense Fund submitted a legal memorandum to the U.S. Senate Judiciary Committee Friday urging it to reject President Obama’s most recent nominees for top-level positions in the U.S. Department of Justice: David Ogden, Elena Kagan, Dawn Johnsen, and Thomas Perrelli. The memo contends that the nominees’ far-left ideology, established through their legal careers, would gravely jeopardize the proper interpretation and application of the U.S. Constitution. “We strongly urge the Senate Judiciary Committee to refrain from appointing David Ogden, Elena Kagan, Dawn Johnsen, and Thomas Perrelli to the Department of Justice, as they have each demonstrated throughout their careers a flawed understanding of the Constitution,” said ADF Senior Counsel Gary McCaleb. “Their legal philosophies depart from mainstream views, their professional careers reflect a far-left ideology, and their involvement in the DOJ could jeopardize the proper enforcement of federal law and the development of constitutional doctrines.” ADF attorneys included in the memo the track records of the four nominees, including Ogden’s staunch advocacy of sexually oriented businesses and abortion , and Kagan’s open hostility towards the military’s “Don’t Ask, Don’t Tell” policy. The policy is favored by a majority of Americans, including a majority of military servicemen and women. Also addressed in the memo is the extreme position on abortion taken by Johnsen, the former legal director for the National Abortion Rights Action League (currently NARAL Pro-Choice America), an organization that has publicly condemned the federal law banning partial-birth abortions. ADF attorneys also consider Perrelli unqualified for a position on the DOJ.
