CHARLESTON, W.V. — Alliance Defense Fund Senior Legal Counsel Byron Babione will be available for media interviews immediately following the hearing before the West Virginia Supreme Court of Appeals in Kutil v. Blake. ADF attorneys submitted a friend-of-the-court brief asking the court to ensure that a 15-month old foster child is placed with a married family in accordance with state law.

“Judges and politicians should never impose a system that knowingly deprives a child of a mom and a dad,” said Babione. “In this case, there are qualified married couples willing to adopt this child, so there is no reason whatsoever to ignore the law and place this child in a non-married household.”

After the parental rights of the biological parents were terminated, the West Virginia Department of Health and Human Resources temporarily placed the child with a same-sex female couple. The couple now wants to adopt the child and claims that their desire is more important than the department’s effort to place the child in a family with a mother and father as the law requires.

The child’s court appointed guardian filed a motion that it was in the young girl’s best interests to be placed in a home with a mother and a father. The Department of Health and Human Resources also moved to place the child with a married couple. A Fayette County Circuit judge granted the motion, but the same-sex couple has now appealed to the West Virginia Supreme Court of Appeals.
