There will still be a hearing Thursday morning, but the topic will be how to best move the case forward, not whether to issue a preliminary injunction. Since the stakes won’t be as high, Boies will stay in New York and therefore be spared the flight and the red-eye back, although two of his colleagues–Ted Uno and Rick Bettan–will be there.”
