Okla. appeals court upholds dismissal
of same-sex ‘divorce’ case

OKLAHOMA CITY — The Oklahoma Court of Civil Appeals has upheld the dismissal of a lawsuit that sought a “divorce” between two women who claimed to have obtained a marriage license in Canada. The court affirmed the trial court’s decision to dismiss the suit because the women failed to produce evidence of their “marriage” and because Oklahoma courts do not have jurisdiction to grant divorces between members of the same sex.

ADF attorneys represented Speaker of the Oklahoma House Chris Benge, on behalf of the Oklahoma House of Representatives, in arguing that Oklahoma law does not permit divorces for same-sex relationships.
