The purpose of this article is to explore the history of the Initiative in limiting the foster and adoptive rights of cohabitating couples in Arkansas and the arguments for and against the ban. In doing so, this article will explain why Initiated Act 1 is unconstitutional, and how it will have a detrimental effect on the best interests of children in foster care in Arkansas.
