The article analyzes and discusses the recognition of marriage between persons of the same sex in Mexico City and its implications from its primary application in the Mexican legal system. The study contains the analysis of the “Company of Conviviality” as a mechanism of recognition of rights of civil character to persons with personal relations of permanent conviviality, between which the persons meet identity of kind different from the correspondent to his sex and the persons sexual preference different from the heterosexual. Also, we study the reform that marriage between persons of the same sex is possible and the criteria that the Supreme Court of Mexico issued on the same basis of a constitutional motion in which they pose the scope of the principle equality in Mexican constitutionalism from the concepts of family, marriage, heterosexuality, homosexuality, adoption and child’s best interests.
