Rick Hassen at Election Law Blog: Initial Thoughts on 9th Circuit Prop. 8 Decision

How Appealing links to numerous reports.

Orin Kerr at the Volokh Conspiracy (Supreme Court Grants Cert in Prop 8 Case): “Why bother with the headlines of today when you can offer the headlines of tomorrow? Judge Reinhardt’s amicus brief in favor of striking down Prop 8 — aimed squarely at Justice Kennedy, naturally, and based largely on his opinion in Romer v. Evans — is available here.”

James Taranto at WSJ: The Ball Heads for His Court
“Although we still think that is Justice Kennedy’s inclination, we hereby walk back our prediction a bit. The court will not find a constitutional right to same-sex marriage in this case, but it will strike down Proposition 8 and thereby reimpose same-sex marriage in California. Reinhard’s decision lays out a way in which Justice Kennedy can do so–and indeed makes it very difficult for Kennedy to uphold Proposition 8.”

Ed Whelan at National Review Bench Memos: It’s still possible, of course, that the Ninth Circuit might take the case en banc, either on its own initiative or on a request from Prop 8 proponents. My own guess is that it won’t do so—and that the Court will grant review of the Ninth Circuit’s ruling before the November elections (and perhaps even hear oral argument in October or November).
