    Pacific Standard: In a New York magazine piece, “The Science of Gaydar,” writer David France looks at the growing scientific evidence for innate differences between gay and straight people. France ends by gazing toward the future, and asks the question, “What if prenatal tests were able to show a predisposition to gayness?” Well, France reports, “[Northwestern University psychological professor] Michael Bailey, for one, isn’t troubled by the moral implications any more than he would oppose fetal screens for potential birth defects, though he quickly adds his personal belief that homosexuality is ‘a good’ on par with heterosexuality.”

“The Most Ingenious Attack on Gay Marriage Bans”

    John Culhane at Slate: The most ingenious of the lot is a modest suit filed last week in Philadelphia. Palladino v. Corbett is the first case to attack a state law that declares a same-sex marriage from another state “void.” That challenge is quite likely to succeed. If it does, it will effectively tear down the whole edifice of refusing to recognize same-sex marriage, and serve as a model for attacks across the country.

    (1) The federal government’s decision not to recognize state-sanctioned marriages of same-sex couples was an unconstitutional intrusion on federalism (a structural claim); or
    (2) The federal government’s decision not to recognize state-sanctioned marriages of same-sex couples was an unconstitutional infringement on a substantive right, e.g., the right to marry (a liberty claim). These are among the many plausible interpretations of Windsor, but some explanations are more plausible than others.
