Joe Infranco at the Baptist Press: It seems almost daily we're reminded of the relentless attack on religious freedom. But we must keep in mind that there are small, but meaningful victories occurring along the way, as well. Recently, a positive trend has developed in case law under the Free Exercise Clause of the First Amendment. This positive trend recognizes and affirms important constitutionally protected freedoms for churches and para-church ministries, such as Christian schools or substance abuse programs.

KIVA.com ABC 7: Brown's lawyers said there's a more practical explanation. "It was late in the day (when we got the subpoena), and it said that we had to produce all of these documents the very next morning. This is like an 18-paragraph request for documents. There was not enough time to file all of these documents, so we filed a motion for a protective order. Under Texas law, when you file a protective order, you don't have to produce the documents unless the court says you have to produce the documents. Once the court said to produce the documents, we produced the documents. Where's the controversy?" said Brown's Alliance Defense Fund lawyer, Joel Oster.

El Paso Times: Brown's attorney, Joel Oster, said the document released by Walker on Monday is unimportant, calling it "a non-issue." . . . But Oster, one of Brown's attorneys, downplayed the document's significance. "The minutes that you refer to are a non-issue," Oster said in an email. "They were properly given to the other side pursuant to the subpoena and the court's instructions. They don't state that the church itself was involved. "In any event, the court already stated that it believes that the church circulated the petitions. ... What the court held, however, was that First Amendment rights were at stake and it would not stop the election."

This is unlikely to have much direct effect on churches . . . But it could affect them indirectly if they have separate ministries such as schools or day care facilities that are not expressly religious and all employees are not required to subscribe to church doctrine . . .

After the presentation, a professor at a local university told me that in West Virginia, what Johnson did with his amendment to the tax code would have been called a 'fat opossum' because it snuck through under cover of darkness. That’s a perfect tag line for the Johnson Amendment . . . It was a bill that got inserted into the tax code through back-room deals made by a powerful Senator who wanted to be able to seek reelection at any cost and, in the process, trampling freedom of speech and the free exercise of religion. We have grown up with a generation of chuch-goers that believe it is illegal for their pastor to address candidates and elections in light of Scripture or church doctrine when there is no valid justification for believing that."

ADF Attorney Erik Stanley writing at speakupmovement.org/church: "Speaker of the House Nancy Pelosi spoke last week at the Catholic Community Conference and urged Catholic priests and bishops to talk up immigration reform from their pulpits. Pelosi reportedy stated, 'The cardinals, the archbishops, the bishops that come to me … say, "We want you to pass immigration reform," and I said, I want you to speak about it from the pulpit.' . . . The point is that the government has been sending mixed messages for too long to our nation’s pastors. On the one hand, politicians encourage pastors to speak from their pulpits when it is convenient, but on the other, the IRS comes knocking on the church’s door when a pastor speaks in a way that is not favored by those in power or crosses the IRS' imaginary line between what is permitted and what is prohibited."

Since their letter speaks for itself, I won’t elaborate further on it. Especially when you could read two different explanations of the letter written by two of the chaplains themselves. But I will introduce you to the signatories of these letters . . .
