Attorney Heater Gebelin Hacker of the Alliance Defense Fund, agrees with the ACLU's assessment, writing in a blog post that the park's decision may be in the running to win "the title of 'Most Unconstitutional Speech Zone Ever.'"

Courthouse News Service: The 9th Circuit seems likely to affirm dismissal of an action that claims Oregon State University administrators violated free speech by trying to eliminate a conservative student newspaper. Judges noted in oral arguments that the newspaper's executives could not pinpoint any particular administrator who engineered the alleged "unwritten policy." . . . Heather Gebelin Hacker, who represents The Liberty's publisher and editor, is an attorney with the Alliance Defense Fund, a conservative nonprofit that says it "fights to defend religious freedom, the sanctity of life, marriage, and the family." . . . At the very least, Hacker said, there is a reasonable inference that facilities head Vincent Martorello "had something to do with the policy" because he was in charge of the people who removed the bins. "This was not an action of a rogue groundskeeper that just decided one day to go and remove all these bins," Hacker said . . .

While this is a nice step, this does not resolve the issue. It is meaningless for Professor Howell to retain his status as an adjunct professor without being able to teach any classes, and the committee’s review of the situation does not change the fact that Professor Howell was relieved of his previously scheduled teaching responsibilities because his instruction to students was deemed not to meet standards of 'inclusivity.' Save for that email, Professor Howell would still be teaching Introduction to Catholicism in the approaching semester. That is a violation of his constitutional rights, and we have indicated as much to the University in our response letter, sent today."

The good news is that after being sued, the university finally relented, changed their policy, and allowed The Liberty to replace their distribution bins on campus, giving them access equal to the other student newspaper on campus. The bad news is that despite the fact that the paper’s distribution bins were banned from most areas of campus for nearly an entire year pursuant to OSU’s policy, the judge found that the students had suffered no constitutional harm and dismissed the case."

ADF Litigation Staff Counsel Heather Gebelin Hacker writing at the ADF Center for Academic Freedom's Academic Freedom File blog: "The Sheeran settlement was a great outcome not just for pro-life students, but for every student at the Community Colleges of Spokane . . . CCS policies actually allowed administrators to require students hosting an outside speaker to present opposing points of view! In fact, that was an administrator’s initial response to Beth Sheeran’s request to hold her pro-life event—it was 'too one-sided' and since 'Washington is a pro-choice state,' they would also have to include pro-choice information . . . The victory does not come free from a sense of foreboding, however. These 'Stop The Hate'-type programs seem to have become vogue among administrator-types, and are cropping up at increasing numbers of schools."
