The Church Report: “The Oklahoma Court of Civil Appeals has upheld the dismissal of a lawsuit that sought a ‘divorce’ between two women who claimed to have obtained a marriage license in Canada . . . ‘The government cannot issue a divorce for a “marriage” it doesn’t recognize,’ said ADF Senior Legal Counsel Austin R. Nimocks. ‘The people of Oklahoma have made it clear that marriage in their state is only between one man and one woman. Jason Mazzone at Balkinization: By finding Proposition 8 to violate the Equal Protection Clause solely on the ground that it withdrew the right of marriage that gays and lesbians previously possessed in California (as a result the earlier state supreme court’s decision), Perry v. Brown produces a curious result. It appears to leave Proposition 8 partially intact.
