Reed, the 9th U.S. Circuit Court of Appeals ruled that San Diego State University could prevent religious groups from selecting leaders based on belief, even though other campus organizations are allowed to be selective about who leads them, and in some cases, who attends their meetings. Sororities and fraternities, for example, are allowed to restrict membership by gender.
Heritage Foundation (12/28): One issue is whether religious student organizations at public universities should be free to select members and leaders who agree with the religious beliefs of the organizations. Just this month, for example, the Alliance Defense Fund sought Supreme Court review for two Christian student organizations that were denied official recognition by San Diego State University because the organizations wished to require members and/or leaders to agree with the religious beliefs of the organizations.

Heritage Foundation: ADF’s request for review in Alpha Delta Chi v. Reed provides an important opportunity for the U.S. Supreme Court to clarify the rights religious organizations at public universities enjoy under the U.S. Constitution. At the same time, decision-makers throughout the country should reflect more deeply on why religious selection by religious organizations is socially beneficial conduct worth protecting, not unjust discrimination that should be banned.

Eugene Volokh at The Volokh Conspiracy: The case is Alpha Delta Chi-Delta Chapter v. Reed (9th Cir. Aug. 2); the opinion basically agrees with Justice Stevens’s concurrence in Christian Legal Society v. Martinez, which took the same view. The Christian Legal Society majority held only that a policy that recognized groups must take all comers — with some modest exceptions — is constitutional. But the logic of that opinion does suggest that policies which simply require groups not to discriminate based on race, religion, sex, sexual orientation, and so on would likewise be constitutional, if they are applied evenhandedly to all groups.
